Article I. Introduction

FactFlow, LLC ("FactFlow," "Company," "we," "our," or "us") respects the privacy of individuals who access or use our website, browser extension, mobile applications, and related services (collectively, the "Services"). This Privacy Policy describes how we collect, use, disclose, retain, and protect information in connection with the Services.

FactFlow is committed to transparency regarding our data practices. Our technology is designed to verify objectively verifiable factual claims against authoritative governmental and institutional records while minimizing the collection of personal information. Wherever reasonably possible, verification occurs using publicly available data and content voluntarily provided through the Services rather than information about individual users.

This Privacy Policy applies whenever you access or use the Services, create an Account, purchase a Subscription, install a browser extension, use a mobile application, or otherwise interact with FactFlow. By using the Services, you acknowledge that you have read this Privacy Policy.

Article II. Scope

This Privacy Policy governs Personal Information collected through:

  1. the FactFlow website;
  2. the FactFlow Chrome Extension;
  3. future browser extensions;
  4. iOS applications;
  5. Android applications;
  6. APIs made available by FactFlow;
  7. customer support communications;
  8. Subscription services;
  9. promotional websites operated by FactFlow.

Except where expressly stated, this Privacy Policy does not govern third-party websites, governmental databases, institutional websites, payment processors, or other services not controlled by FactFlow.

Article III. Definitions

Unless otherwise defined herein, capitalized terms shall have the meanings assigned in the Terms of Service.

An "Account" means a registered user profile maintained by FactFlow.

"Browser Tab Audio" means audio transmitted from a browser tab that a User has expressly selected and authorized for processing through browser permission controls. Browser Tab Audio does not include:

A "Claim" means an objectively verifiable factual assertion capable of comparison against authoritative governmental, institutional, or established research records. Opinions, satire, rhetorical statements, predictions, campaign promises, subjective characterizations, and value judgments are not Claims.

4. Institutional Sources

"Institutional Sources" means governmental agencies, statistical organizations, public institutions, election authorities, international organizations, academic institutions, established research organizations, and other authoritative entities whose publicly available records are used during verification.

5. Mobile Device Audio

"Mobile Device Audio" means audio captured through a mobile device microphone that a User has expressly authorized through operating system permission controls for the purpose of live verification of ambient broadcasts. Mobile Device Audio is processed solely for Claim identification and verification and is not permanently stored unless the User affirmatively elects to save a Verification Session.

6. Personal Information

"Personal Information" means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked to an identified or identifiable individual, whether directly or indirectly. Personal Information does not include anonymized or aggregated information that cannot reasonably be used to identify an individual.

7. Services

"Services" means all websites, software, browser extensions, applications, APIs, subscriptions, and related services operated by FactFlow.

8. Source Record

A "Source Record" is an official governmental, institutional, or established research publication, report, dataset, filing, statistical release, or other authoritative record consulted during verification.

9. Verification Result

"Verification Result" means the output generated after comparison of a Claim against available Source Records. Verification Results include:

Article IV. Our Privacy Principles

FactFlow has designed its Services around the following principles.

4.1 Data Minimization

We seek to collect only the information reasonably necessary to operate, secure, improve, and support the Services.

4.2 User Control

Processing of browser-tab audio or mobile device audio occurs only after the User affirmatively enables that functionality through browser or operating system permission controls. FactFlow does not activate audio capture without user action.

4.3 Limited Audio Collection

On the browser extension, FactFlow does not access microphone audio. Audio processing is limited to Browser Tab Audio from a user-selected tab.

On the mobile application, FactFlow accesses microphone audio solely when the User affirmatively activates the live-capture feature, and only for the purpose of identifying and verifying Claims in ambient broadcasts. Mobile Device Audio is processed in real time and is not permanently stored unless the User elects to save the session.

4.4 Public Information First

Verification is performed primarily by comparing Claims against publicly available governmental and institutional records rather than by collecting additional information about users.

4.5 Transparency

Where practical, FactFlow provides citations identifying the Source Records supporting a Verification Result so that users may independently review the underlying information.

4.6 Security

FactFlow employs administrative, technical, and organizational safeguards reasonably designed to protect Personal Information against unauthorized access, disclosure, alteration, or destruction.

Article V. Information We Collect

The categories of information collected depend upon how the Services are used. We do not require users to provide demographic information, political affiliation, race, religion, or similar sensitive personal information to use the Services.

Article VI. How the Services Process Content

6.1 Overview

The Services are designed to identify objectively verifiable factual Claims and compare those Claims against publicly available Source Records maintained by Institutional Sources. Except as described in this Privacy Policy, FactFlow does not collect audiovisual content for purposes unrelated to verification, advertising, or user profiling.

6.2 Caption-Based Verification

When caption data is available from a supported platform, the Services may process caption text solely for the purpose of:

  1. identifying potential Claims;
  2. determining whether a statement is objectively verifiable;
  3. selecting one or more appropriate Institutional Sources;
  4. retrieving relevant Source Records;
  5. generating a Verification Result;
  6. displaying supporting Citations.

Caption text is processed only to the extent reasonably necessary to perform these functions.

6.3 Browser Tab Audio Processing

Certain premium features permit Users to enable Browser Tab Audio processing where caption data is unavailable. Browser Tab Audio processing occurs only after the User affirmatively authorizes the browser to share audio from a selected browser tab. FactFlow does not activate Browser Tab Audio processing automatically.

Browser Tab Audio processing is limited to the selected browser tab and is not intended to capture:

6.4 Mobile Device Audio Processing

The mobile application includes a live-capture feature that, when affirmatively activated by the User, accesses the device microphone to capture audio from an ambient broadcast such as a debate, speech, or television program for real-time claim verification. Mobile Device Audio processing:

Users may revoke microphone permission at any time through their device operating system settings.

6.5 Live Event Processing

During designated live events, including debates, speeches, press conferences, or similar broadcasts, FactFlow may centrally process publicly available event audio in order to generate Verification Results for distribution to Users. In this broadcast model, FactFlow processes the event audio once through a centralized pipeline and distributes the resulting Verification Results to all Users viewing the same event. This means:

At launch, FactFlow is not designed to identify individuals using biometric voice characteristics. The Services are not intended to:

Where speakers are identified, such identification is intended to rely upon publicly available information, including event programming, official participant lists, on-screen graphics, transcripts, or similar contextual information.

If FactFlow introduces any functionality that processes biometric voice characteristics in the future, this Privacy Policy will be updated and, where required by applicable law, User consent will be obtained prior to such processing.

6.7 Machine Learning and AI Processing

FactFlow uses third-party machine learning models to assist in identifying potential Claims within transcribed text and determining whether statements are objectively verifiable. This processing is performed solely for the purpose of claim extraction and verification routing. Content processed through machine learning models is subject to the data processing agreements FactFlow maintains with its AI infrastructure providers. FactFlow does not use User content to train machine learning models.

6.8 Temporary Technical Processing

To provide verification functionality, portions of audio or text may be temporarily processed in volatile memory or transient computing environments. Such temporary processing does not necessarily result in permanent storage. FactFlow may discard temporary processing artifacts immediately following completion of a Verification Session except where retention is reasonably necessary for debugging, fraud prevention, legal compliance, or system integrity.

Third-party providers engaged in audio transcription or machine learning processing may transiently process content in accordance with their own data processing agreements with FactFlow. FactFlow requires that such providers do not retain User content beyond the period necessary to perform the contracted service.

Article VII. How We Use Information

FactFlow uses Personal Information and other information collected through the Services for legitimate business purposes, including the following.

Article VIII. Legal Bases for Processing

To the extent applicable under international privacy laws, FactFlow processes Personal Information under one or more of the following legal bases.

8.1 Contract Performance

Processing necessary to provide the Services requested by the User.

8.2 Legitimate Interests

Processing reasonably necessary for operating the Services, preventing fraud, improving accuracy, ensuring security, maintaining reliability, and responding to customer inquiries.

8.3 Consent

Where required by law, FactFlow relies upon User consent, including consent provided through browser or operating system permission controls for audio processing. Users may withdraw consent where applicable; however, withdrawal may limit functionality dependent upon such consent.

8.4 Legal Obligations

Processing necessary to comply with legal obligations imposed under applicable law.

Article IX. Third-Party Service Providers

FactFlow may engage carefully selected third-party providers to assist in operating the Services. Such providers may process information solely on FactFlow's behalf and only for purposes consistent with this Privacy Policy.

9.1 Payment Processing

Subscription payments are processed by Stripe, Inc., or its affiliates. FactFlow does not store complete payment card numbers or payment authentication data. Payment information is governed by Stripe's applicable privacy policies and contractual terms.

9.2 Cloud Infrastructure

FactFlow utilizes third-party cloud infrastructure providers to host applications, databases, logs, and related systems. Such providers may process Personal Information only to the extent reasonably necessary to provide contracted hosting services.

9.3 Audio Transcription and AI Processing

FactFlow engages third-party providers for audio-to-text transcription and machine learning processing necessary to identify and verify Claims. These providers process content under data processing agreements that restrict use of such content to performing the contracted service and prohibit retention beyond the period necessary to complete processing.

9.4 Analytics

FactFlow may utilize analytics providers to understand application stability, feature usage, performance, crash reporting, and service reliability. Analytics information is used to improve the Services and is not sold to third parties.

9.5 Customer Support

Customer support platforms may process support requests, communications, and account information necessary to respond to inquiries.

Article X. Disclosure of Information

FactFlow does not sell Personal Information. Subject to applicable law, we may disclose information in the following circumstances.

10.1 Service Providers

To vendors providing services on our behalf under contractual confidentiality obligations.

10.2 Corporate Transactions

In connection with mergers, acquisitions, reorganizations, financings, asset sales, or similar business transactions.

10.3 Legal Process

To comply with subpoenas, court orders, warrants, lawful governmental requests, regulatory investigations, or other legal obligations. Whenever reasonably permitted by law, FactFlow may notify affected Users before producing Personal Information in response to legal process.

To investigate or prevent fraud, abuse, security incidents, unlawful conduct, violations of our Terms of Service, or threats to the safety or rights of Users or the public.

10.5 Aggregate Information

FactFlow may publish or disclose anonymized or aggregated statistical information that cannot reasonably identify individual Users.

Article XI. Data Retention

11.1 General Retention Policy

FactFlow retains information only for as long as reasonably necessary to provide the Services, administer Accounts, maintain Subscription records, improve system performance, investigate fraud or abuse, satisfy contractual obligations, comply with applicable law, or establish, exercise, or defend legal claims. When information is no longer reasonably necessary for these purposes, FactFlow will delete, anonymize, aggregate, or otherwise de-identify such information in accordance with its internal retention procedures, unless a longer retention period is required or permitted by law.

11.2 Account Information

Account registration information may be retained for the duration of the User's Account and for a reasonable period thereafter (generally no more than twelve months following account closure) to process account closure, resolve disputes, comply with tax and accounting obligations, detect fraud, and enforce contractual rights.

11.3 Subscription Records

Billing records, invoices, transaction identifiers, and related accounting information may be retained for the period required by applicable tax, accounting, financial reporting, and audit obligations (generally seven years). FactFlow does not retain complete payment card numbers or payment authentication data.

11.4 Verification Activity

FactFlow may retain Verification Session metadata, Claims submitted for verification, Verification Results, timestamps, and associated technical logs for purposes including improving verification accuracy, diagnosing software issues, detecting abuse, investigating security incidents, defending legal claims, and maintaining system integrity. Where reasonably practicable, such records may be retained in de-identified or aggregated form.

11.5 Verification Audit Records

Each Verification Result is recorded with a tamper-resistant timestamp in FactFlow's audit system. These audit records are designed to be permanent and immutable in order to provide a verifiable record of every verdict issued by the system. Because of their immutable nature, audit records cannot be deleted on request; however, they do not contain Personal Information beyond the Claim text, Verification Result, Source Record citation, and timestamp. Audit records do not identify the User who initiated the verification.

11.6 Diagnostic Logs

Server logs, application logs, crash reports, and diagnostic information may be retained for periods reasonably necessary (generally no more than ninety days) to monitor availability, identify software defects, investigate outages, improve reliability, and detect malicious activity.

11.7 Legal Holds

Notwithstanding any other provision of this Privacy Policy, FactFlow may preserve information subject to litigation holds, preservation notices, governmental requests, subpoenas, court orders, or other legal obligations until such obligations have been satisfied.

Article XII. Information Security

12.1 Security Program

FactFlow maintains administrative, technical, and physical safeguards reasonably designed to protect Personal Information against accidental or unlawful destruction, loss, alteration, unauthorized disclosure, or unauthorized access. Security measures may include encrypted communications, authenticated access controls, least-privilege authorization, network monitoring, logging and auditing, vulnerability management, software updates, and employee access controls. The specific safeguards implemented by FactFlow may evolve as technology and security practices develop.

12.2 No Absolute Security

Although FactFlow employs commercially reasonable security measures, no method of electronic transmission, storage, or processing can be guaranteed to be completely secure. Accordingly, FactFlow cannot warrant or guarantee that unauthorized access, disclosure, alteration, or destruction of information will never occur.

12.3 User Responsibilities

Users remain responsible for maintaining the confidentiality of their Account credentials and for promptly notifying FactFlow of any suspected unauthorized access to their Account.

Article XIII. Cookies and Tracking Technologies

FactFlow and its service providers may use cookies, local storage, and similar technologies to operate and improve the Services.

13.1 Essential Cookies

These are necessary for the Services to function and cannot be disabled. They include session authentication, security tokens, and user preference storage.

13.2 Analytics Cookies

FactFlow may use analytics technologies to measure service performance, feature usage, and reliability. Analytics data is used solely to improve the Services and is not sold to third parties.

13.3 Managing Cookies

Users may manage or disable cookies through their browser settings. Disabling certain cookies may limit the functionality of the Services. Where applicable law requires consent for non-essential cookies, FactFlow will obtain such consent before placing them.

13.4 Do Not Track and Global Privacy Control

FactFlow honors Global Privacy Control (GPC) signals transmitted by a User's browser to the extent required by applicable law. FactFlow does not currently respond to Do Not Track (DNT) browser signals, as no uniform industry standard for DNT compliance has been established.

Article XIV. Data Breach Notification

In the event of a security breach involving Personal Information, FactFlow will notify affected Users and applicable regulatory authorities as required by applicable law. Where legally required, such notification will be provided within the timeframes mandated by the jurisdiction in which the affected User resides. Notification may be provided by email, through the Services, or by other means reasonably calculated to reach the affected User.

Article XV. International Transfers

FactFlow is headquartered in the United States. Personal Information may be stored, processed, or accessed in the United States or other jurisdictions in which FactFlow or its service providers maintain operations. By using the Services, Users acknowledge that information may be transferred to jurisdictions whose privacy laws differ from those of the User's jurisdiction. Where applicable, FactFlow will implement appropriate safeguards for international transfers as required by applicable law.

Article XVI. Your Privacy Rights

16.1 Right of Access

To request confirmation regarding whether FactFlow processes Personal Information relating to the User.

16.2 Right to Correction

To request correction of inaccurate Personal Information maintained by FactFlow.

16.3 Right to Deletion

To request deletion of Personal Information, subject to applicable legal exceptions. FactFlow may deny deletion requests where retention is required for legal compliance, fraud prevention, contractual obligations, security investigations, or defense of legal claims. Users should note that verification audit records (described in Section 11.5) are immutable by design and cannot be deleted; however, these records do not contain information identifying the requesting User.

16.4 Right to Data Portability

Where applicable, Users may request a portable copy of Personal Information provided to FactFlow.

16.5 Right to Withdraw Consent

Where processing is based upon consent, Users may withdraw such consent at any time. Withdrawal of consent does not affect the lawfulness of processing conducted before withdrawal.

16.6 Right to Appeal

Where required by applicable law, Users whose privacy requests are denied may submit an appeal in accordance with procedures made available by FactFlow.

Article XVII. U.S. State Privacy Disclosures

Residents of certain U.S. states, including California, Colorado, Connecticut, Virginia, Utah, and other jurisdictions that enact comprehensive privacy legislation, may possess additional statutory rights. FactFlow does not sell Personal Information as that term is defined under applicable state privacy laws. FactFlow does not knowingly share Personal Information for cross-context behavioral advertising in a manner requiring an opt-out under applicable law. Where applicable law requires recognition of browser-based opt-out preference signals, including Global Privacy Control, FactFlow will honor such signals to the extent required. Users may exercise applicable privacy rights by contacting FactFlow using the contact information provided in this Privacy Policy.

Article XVIII. Children's Privacy

The Services are not directed to children under thirteen (13) years of age. FactFlow does not knowingly collect Personal Information from children under thirteen. If FactFlow becomes aware that Personal Information has been collected from a child under thirteen without legally sufficient parental authorization, FactFlow will take reasonable steps to delete such information. Where higher minimum ages apply under applicable law, FactFlow will comply with those requirements.

Article XIX. Changes to This Privacy Policy

FactFlow may amend this Privacy Policy from time to time to reflect changes in applicable law, modifications to the Services, security developments, technological improvements, operational changes, and regulatory guidance. Material changes may be communicated through the Services, electronic mail, or other reasonable means. The revised Privacy Policy shall become effective upon the effective date identified in the updated version unless otherwise required by law.
